Terms of service

1. Who we are and what these terms cover

Facet (fourstudio.co) is operated by Vincent Seidel – Four Studio, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany (“Four Studio”, “we”). These terms govern your use of Facet. Some provisions apply only to consumers — people using Facet for purposes outside their trade, business or profession — and we say so where that is the case. Our Acceptable Use Policy is part of these terms.

2. Eligibility and your account

• You must be at least 18 years old.
• Give accurate information and keep your login secure. You are responsible for activity in your account.
• One person, one account. Creating several accounts to collect free credits is not allowed.

3. The service

Facet lets you sculpt synthetic faces in a 3D editor that runs in your browser, render them photoreal (Face Creator), give them a body and create photo sets of the same character with captions (Character Creator), and keep and download your images. Rendering uses AI models from third-party providers, so results vary and can differ from what you expected. Features marked as beta may change.

4. Credits

• Rendering and other AI features cost credits. We show the cost before you start (for example, one face render costs 6 credits).
• New accounts receive a one-time starter allowance of 6 credits, free of charge.
• Plans include a monthly credit allowance. It is valid for the billing period it belongs to; credits from it that are unused at the end of the period expire and do not carry over.
• You can buy additional credits at any time, from US$10 per purchase. Credits you buy — and the starter credits — do not expire as long as your account exists.
• Plan credits are always used first, then credits you bought.
• If a generation fails or is blocked by a safety filter, the credits are returned to you automatically.
• Credits have no cash value, cannot be transferred and are not exchanged for money, except where sections 7, 8 or 12 or mandatory law provide otherwise.

5. Plans, prices and payment

• Plans and prices are shown on our pricing page. Prices are in US dollars and are final prices: as a small business under § 19 of the German VAT Act (UStG) we do not charge VAT.
• You buy plans and credits from us. Payments are processed by our payment provider Stripe; you receive a receipt by email.
• Subscriptions renew automatically every month at the then-current price until you cancel. You are charged at the start of each billing period.
• If we change the price of your subscription, we tell you by email at least 30 days before it applies to you. You can cancel before then.

6. Cancelling your subscription

You can cancel at any time, with effect from the end of the current billing period: in your account (“Manage subscription”), with the “Cancel contracts here” button on our website, or by email to hello@fourstudio.co. There is no cancellation fee. After the period ends your account, your images, the free features and the credits you bought remain; unused plan credits expire.

7. Refunds

• Failed or blocked generations: the credits come back automatically (section 4).
• Payments for a billing period that has started are not refunded pro rata, except under your right of withdrawal (section 8), where mandatory law requires it, or where Facet was unavailable for a substantial part of the period for reasons we are responsible for.
• If you think you were charged in error, contact us within 30 days — we will sort it out. Please contact us before disputing a payment with your bank; we may suspend accounts with unjustified chargebacks.

8. Right of withdrawal (consumers in the EU)

Withdrawal notice. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise it, you must inform us (Vincent Seidel – Four Studio, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany, hello@fourstudio.co) of your decision by a clear statement (for example, an email). You may use the model form below, but you do not have to. It is enough to send your notice before the withdrawal period expires.

Effects of withdrawal. If you withdraw, we refund all payments received from you without undue delay and at the latest within 14 days of receiving your notice, using the same means of payment you used, without any fees. If you asked us to start the service during the withdrawal period, you pay an amount proportionate to what we provided until you told us of your withdrawal, compared with the full service under the contract (for example, the credits you used).

When the right expires. Your right of withdrawal expires when we have fully performed the service, if you expressly agreed that we begin before the withdrawal period ends and acknowledged that you lose your right once the contract is fully performed. We ask for this consent at checkout.

9. Your content and your rights

• Your inputs (face parameters, prompts, photos you upload) and the images Facet generates for you belong to you, as far as the law allows. In some countries AI-generated images may not be protected by copyright, and similar images may be generated for other users.
• You may use your images commercially while you are on a paid plan (Creator, Studio), including images made during that time. On the free plan they are for personal, non-commercial use. Buying credits does not change the usage rights of your plan.
• You give us the rights we need to run Facet for you: to store, process and transmit your content, including to the AI providers that render it. We do not use your images to train AI models.
• Clay body figures you create in the Character Creator contain no personal features. We may keep and reuse them, for example in a shared body catalog.
• You are responsible for how you use your images, including labelling them as AI-generated where the law or a platform’s rules require it.

10. Acceptable use

Facet creates synthetic people. You may not use it to recreate real people without their consent, for sexual content, for anything involving minors in a sexual context, to deceive or defraud, or for unlawful content. The full rules are in our Acceptable Use Policy.

11. Availability and changes to Facet

We work to keep Facet available but cannot guarantee uninterrupted service — maintenance, our providers or circumstances outside our control can interrupt it. We may develop, change or discontinue features. If a change substantially reduces what your paid plan includes, we tell you in advance and you may cancel.

12. Suspension and termination

• You can stop using Facet and have your account deleted at any time by email to hello@fourstudio.co. Credits left in your account lapse when it is deleted — we remind you before.
• We may suspend or close an account for serious or repeated breaches of these terms or the Acceptable Use Policy, for fraud or abuse of free credits, or where the law requires it — for serious breaches without prior notice.
• If we close your account without cause on your side, or discontinue Facet, we refund prepaid fees and unused paid credits pro rata.

13. Liability

• We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantee we have given.
• For slight negligence we are liable only for breaches of essential contractual obligations — obligations whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely — and only up to the damage typical and foreseeable for this kind of contract.
• Otherwise our liability is excluded. These limits also apply to our staff and agents.
• For users outside the EU: to the extent permitted by applicable law, Facet is provided “as is” and our total liability is limited to the amounts you paid us in the 12 months before the claim arose.

14. Changes to these terms

We may update these terms, for example for new features or legal requirements. We tell you about changes at least 30 days before they apply to you. If you do not agree, you can cancel your subscription before that date.

15. Law, jurisdiction and disputes

• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of mandatory law in the country where you live.
• For merchants, the exclusive place of jurisdiction is Berlin.
• We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
